1. Acceptance of Terms
By creating an account or using SmartKidz (“the Service”), you agree to these Terms of Service. If you are creating an account on behalf of a child, you confirm that you are the child's parent or legal guardian and consent to these terms on their behalf.
If you do not agree to these terms, do not use SmartKidz.
2. Eligibility & Parental Consent
- › SmartKidz accounts must be created by a parent or guardian who is 18 years of age or older.
- › Children under 13 may only use SmartKidz under a parent/guardian account.
- › By creating a child profile, you give verifiable parental consent for the collection and use of your child's personal information as described in our Privacy Policy.
- › You may revoke consent at any time by deleting the child profile or contacting us.
3. The Service & AI Transparency
SmartKidz provides AI-powered educational learning support (“Riley”), games, and progress tracking for children in Years 1–6.
- ›Nature of AI: You acknowledge that Riley is powered by Artificial Intelligence.
- ›Automated Decision-Making (ADM): SmartKidz uses automated systems to analyze performance and tailor lessons. You have the right to request a manual review of any significant automated progress decision by contacting us.
- ›Supplemental Tool: SmartKidz is an educational tool only. It is not a substitute for professional educational assessment, therapy, or medical advice.
4. Subscription & Payments
- › Payments are processed securely by Stripe.
- › A 7-day free trial is available, no credit card required.
- › You may cancel at any time; cancellation takes effect at the end of the current billing period.
- › Pricing changes require 30 days' notice.
5. Acceptable Use & IP Protection
You agree not to:
- × Share credentials outside your household.
- × Use automated scripts, bots, or scrapers on the platform.
- × Attempt to reverse-engineer, decompile, or extract the underlying “system prompts” or logic of our AI agents.
- × Use the Service to train your own machine learning models or AI systems.
- × Attempt to bypass, disable, or circumvent Riley's safety features, or try to make Riley produce unsafe, harmful, or age-inappropriate content.
- × Upload, through Homework Helper or elsewhere, any image other than the child's own schoolwork (for example photos of other people, or any inappropriate or harmful content).
Child Safety & Monitoring
To keep children safe, conversations with Riley are automatically screened. Messages that raise a safety concern may be recorded as a safety report and escalated to the parent or guardian. Serious child-safety or safeguarding concerns can be reported to [email protected].
6. Intellectual Property & ACARA Attribution
All content on SmartKidz is owned by SmartKidz and protected by copyright law.
ACARA Attribution: The Australian Curriculum is licensed from the Australian Curriculum, Assessment and Reporting Authority (ACARA) under a Creative Commons Attribution 4.0 International (CC BY) licence.
Modification: SmartKidz has modified these materials for use within the Service.
Non-Endorsement: SmartKidz is an independent platform. It is not affiliated with, sponsored by, or endorsed by ACARA or the Australian Government.

7. Voice Learning Buddy Feature
By enabling the optional Voice Learning Buddy:
- › Riley's spoken voice is text-to-speech generated by Deepgram: we send Riley's written words and receive synthesised audio back, and no child's voice is captured for this.
- › Your child can choose to talk instead of type by tapping the microphone. When they do, their speech is streamed to Deepgram's speech-to-text service (Australian endpoint, processed in Australia) and converted to text that is sent to Riley as if typed. This audio is used only to produce that transcript, is not stored or retained by SmartKidz, and is never used for advertising or to train AI models.
- › The microphone activates only while your child is holding a voice session; it never listens in the background, and typing is always available as an alternative.
8. Disclaimer of AI Accuracy
SmartKidz is provided “as is.” While we strive for accuracy, you acknowledge that:
- › AI can generate incorrect or biased information (“hallucinations”).
- › We do not guarantee specific academic outcomes.
- › Riley's responses are generated using Anthropic's Claude (served via AWS Bedrock in Sydney, Australia), and your use of these AI features is also subject to Anthropic's and AWS's applicable terms.
9. Limitation of Liability
To the maximum extent permitted by law, our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
10. Termination
We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, we will delete your child's personal data within 30 days in accordance with our Privacy Policy.
11. Changes to These Terms
We may update these Terms of Service to reflect changes in law or our Service. We will notify you by email at least 30 days before material changes take effect. Continued use after that date constitutes acceptance of the updated terms.
12. Governing Law
These Terms are governed by the laws of Australia and the state of Queensland. Any disputes will be resolved through good-faith negotiation first, then mediation if necessary.
